Article 1 – Definitions

In these general terms and conditions, the following definitions apply:

Additional agreement
An agreement whereby the consumer obtains products, digital content and/or services related to a distance contract and which are supplied by Daily7 Kids or a third party.

Reflection period
The period within which the consumer can exercise the right of withdrawal.

Consumer
The natural person who does not act in the exercise of a profession or business and enters into an agreement with Daily7 Kids.

Day
Calendar day.

Durable data carrier
Any means by which information can be stored in such a way that it can be consulted unchanged in the future, such as email or a PDF document.

Right of withdrawal
The right of the consumer to withdraw from the distance contract within the applicable reflection period.

Entrepreneur
Brands4kids B.V., trading under the trade name Daily7 Kids.

Distance contract
An agreement concluded exclusively through one or more techniques for distance communication, such as through the webshop.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer from Daily7 Kids and to every agreement concluded via the webshop between Daily7 Kids and a consumer.

  2. By placing an order, the consumer declares to have read and agreed to these general terms and conditions.

  3. If one or more provisions of these general terms and conditions are wholly or partially null and void or are annulled, the remaining provisions will remain fully in force.

  4. Deviations from these general terms and conditions are only valid if agreed in writing.

  5. In cases not covered by these general terms and conditions, the applicable Dutch laws and regulations will apply.

Article 4 – The offer

  1. All offers on the website are without obligation.

  2. Daily7 Kids takes the utmost care in describing and displaying the offered products.

  3. Images, colors, sizes and product specifications are displayed as accurately as possible. Small color differences may occur due to screen settings and do not entitle the consumer to dissolve the agreement.

  4. Obvious errors, mistakes or misprints in prices, images or product information are not binding on Daily7 Kids.

  5. An offer is valid as long as stocks last.

  6. If a product turns out to be temporarily unavailable after an order has been placed, the consumer will be informed of this as soon as possible. Any amounts already paid for the product concerned will be refunded.

Article 5 – Conclusion of the agreement

  1. The agreement is concluded as soon as the consumer places an order via the webshop and Daily7 Kids has confirmed this order by e-mail.

  2. Daily7 Kids reserves the right to refuse an order or to attach additional conditions if there is a justified reason, for example in the event of:

    • incorrect personal data;

    • suspicions of fraud;

    • payment problems;

    • evident errors in price or product information.

  3. If an order cannot be executed in whole or in part, the consumer will be informed of this as soon as possible. Any amounts already paid for the part that cannot be delivered will be refunded.

  4. Daily7 Kids takes appropriate technical and organizational measures to secure electronic payments and personal data.

  5. After placing an order, the consumer receives an order confirmation by e-mail containing an overview of the order.

Article 6 – Right of withdrawal

  1. When purchasing products via the webshop, the consumer has the right to withdraw from the agreement without stating reasons within 30 days after receiving the order. This period is an additional service from Daily7 Kids on top of the statutory reflection period.

  2. The withdrawal period starts on the day after the consumer, or a third party designated by the consumer who is not the carrier, has received the product.

  3. When an order consists of several products that are delivered separately, the withdrawal period starts on the day on which the last product was received.

  4. During the reflection period, the consumer must handle the product and its packaging with care. The product may only be used to the extent necessary to ascertain its nature, characteristics and functioning, as would also be possible in a physical store.

  5. To exercise the right of withdrawal, the consumer must inform Daily7 Kids within the withdrawal period by means of an unambiguous statement, for example by e-mail to service@daily7kids.com or by using the model withdrawal form.

  6. After the consumer has reported the withdrawal, the product must be returned as soon as possible, but no later than within 14 days.

Article 7 – Returns and refunds

  1. Daily7 Kids offers consumers the option to return products within 30 days of receipt, provided that the return conditions are met.

  2. Products must be:

    • unworn and unwashed;

    • free from damage;

    • provided with the original labels, as far as reasonably possible;

    • returned complete.

  3. Swimwear can only be returned if the hygiene seal is intact and the item has not been worn, other than for fitting with one's own underwear.

  1. If the Daily7 Kids return procedure is used, the return costs are € 3.99 per order. This amount will be deducted from the purchase amount to be refunded.

  2. If the consumer chooses another method of return, the direct costs of the return shipment are entirely for the account of the consumer.

  3. Daily7 Kids processes returns as quickly as possible. The purchase amount will be refunded no later than 14 days after the withdrawal has been received. Daily7 Kids may wait with repayment until the return shipment has been received or until the consumer has demonstrated that the product has been shipped, whichever occurs first.

  4. Upon return of the entire order, the paid standard shipping costs will also be refunded. If only a part of the order is returned, the original shipping costs will not be refunded.

  5. Refunds are made via the same payment method used for the original payment, unless otherwise agreed.

Article 8 – Exclusion of the right of withdrawal

The right of withdrawal does not apply to:

  • products manufactured according to the consumer's specifications;

  • products that are clearly personal in nature;

  • sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;

  • other products for which the right of withdrawal can be legally excluded under the law.

If an exclusion applies, this will be clearly stated before the agreement is concluded.

Article 9 – Prices

  1. All prices on the website are stated in euros and include VAT.

  2. Any shipping costs will be clearly stated before the order is completed.

  3. Daily7 Kids reserves the right to change prices. Price changes do not affect already confirmed orders.

  4. Obvious price, typing or printing errors can be corrected by Daily7 Kids, even after an agreement has been concluded, provided there is an evident mistake.

  5. Any promotions or discount campaigns are only valid during the specified promotional period and while stocks last.
